Data Act: EU co-legislators must ensure fair access to data for research purposes

As associations of universities and university libraries, we call on co-legislators engaged in interinstitutional negotiations on the EU Data Act to ensure that the legislation is inclusive and recognises the specific needs of research and research organisations.

Universities and non-profit scientific knowledge sectors play a vital role in supporting the European digital transformation. According to the provisions under Chapter V of the proposed Data Act, data must be made available to public bodies, including public universities and research organisations, in case of exceptional need.

We welcome that the European Parliament and the Council supported these provisions in their positions adopted in March 2023. However, we urge co-legislators to maintain certain improvements in the final text and ensure that non-profit scientific knowledge is not treated as the for-profit commercial sector, where relevant.

Jan Palmowski, Secretary-General of The Guild said: ‘’Excellent research requires access to data. The Data Act can ensure that Europe’s researchers are at the forefront of research, by getting access to commercially held data, in the public interest. For this to happen, it is essential that the Data Act is not undermined by provisions around cost or excessive privacy protections. The sharing of data for public research purposes must become a reality – for the public good!’’.
